Acceptable Use Policy

At Flexspeak, we are committed to fostering an inclusive, safe, and respectful environment for all users. To ensure a positive experience for everyone, all users must comply with this Acceptable Use Policy.

Flexspeak reserves the right to determine, at its sole discretion, whether content or usage violates this Policy. We may update this Policy from time to time to reflect our commitment to maintaining a responsible and supportive communication platform.

1. Anti-Discrimination & Inclusive Communication

Flexspeak does not support and will not tolerate the use of our platform for discrimination against others, particularly based on disability, race, religion, sex, sexual orientation, age, ancestry, or national origin.

Users may not use Flexspeak to incite, promote, or support discrimination, hostility, or violence against any individual or group. If we determine that your use of the platform violates this Policy, we may permanently or temporarily suspend your access without prior notice or liability.

2. General Use Guidelines

You agree not to upload content, create messages, or use Flexspeak in any way that:

• Promotes or creates a risk of physical or emotional harm, distress, or exploitation of any individual, including children and vulnerable individuals.

• Encourages or incites violence, self-harm, or harm to others.

• Is harassing, abusive, defamatory, racially or ethnically offensive, invasive of personal privacy, libelous, or threatening, including by sharing personal information such as home addresses, phone numbers, email addresses, student IDs, medical information, or login credentials.

• Discriminates against others based on disability, race, religion, sex, sexual orientation, age, ancestry, or national origin.

• Contains sexually explicit, pornographic, or inappropriate material.

• Involves the sale or promotion of illegal or prohibited activities, products, or services.

• Promotes fraudulent or deceptive activity.

• Violates the intellectual property rights, privacy rights, or other legal rights of any individual or third party.

• Contains false, deceptive, or misleading information, including misinformation, disinformation, or impersonation of another person, including through custom recordings, cloned voices, or other audio.

• Violates any applicable law or regulation.

• Includes a voice recording or other personal information relating to a student, child, or other person that you do not have authorization to share with the intended audience.

• Includes a custom recording that is private, identifying, or otherwise inappropriate for the audience who will play the published visual.

3. Publishing Visuals and Custom Recordings

When you publish a visual to a school library or the Flexspeak Community, Flexspeak copies the visual as it exists at the time you submit it. That copy can include custom recordings you added to tiles. People who play the published visual will hear those recordings. Typed “Spoken as” text is not a substitute for a recording. If a recording is selected, the recording is what plays.

School library publishing and Flexspeak Community publishing are different. A recording that is appropriate for an internal school library may be inappropriate for the public Flexspeak Community.

School library. A school library is visible to people in your school or organization. You may publish a visual with a custom recording to a school library only if you are authorized to share that recording with that audience. You, not Flexspeak, are responsible for complying with your school or district’s policies and with applicable privacy and student-record laws, including FERPA where applicable. Flexspeak does not determine whether your consent or authorization is sufficient.

Flexspeak Community. The Flexspeak Community is public to Flexspeak users. Do not publish a student’s or child’s name, voice, or other identifying information to the Flexspeak Community, including in recordings or tile labels.

You remain responsible for having all rights, permissions, and authorizations needed to publish your content to the intended audience. Review or approval by Flexspeak, or by a school-library reviewer, does not mean Flexspeak has verified that you have those rights or permissions.

If you do not want a recording included, switch the tile back to Spoken as or remove the recording in the editor before you publish. Changes you make after you submit do not update the published copy. You will need to publish or submit again.

Flexspeak may remove, restrict, or disable access to published content, and may restrict or disable accounts that violate this Policy. School library and Flexspeak Community reviewers may also reject a submission if a recording is inappropriate, identifying, or otherwise inconsistent with this Policy.

4. Safeguards for Users with Disabilities

‍Flexspeak recognizes that some users, particularly those with disabilities, may unintentionally create or share content that does not comply with this policy due to their communication differences, cognitive processing, or other related challenges. Our approach to policy enforcement considers these factors, and we prioritize education, guidance, and supportive interventions before taking any restrictive actions. When a potential violation occurs, Flexspeak may:

• Notify the user, their caregiver, educator, or support staff about the issue.

• Provide guidance on appropriate use of the platform.

• Offer resources or alternative communication strategies.

• Limit access to certain features as necessary while maintaining core communication access.

Flexspeak remains committed to accessibility and ensuring all users can communicate effectively while maintaining a safe and respectful environment for everyone.

‍5. Enforcement & Consequences

‍Flexspeak reserves the right to investigate and take appropriate action against any violation of this Policy, including but not limited to:

• Removing or restricting access to certain features.

• Temporarily or permanently suspending user accounts.

• Reporting violations to law enforcement when necessary.

• Removing, restricting, or disabling access to content, including published visuals.

We encourage users to report any misuse or violations to our support team to help us maintain a safe and inclusive platform.
